Guarantee

  1. This warranty is issued by Tomasz Pacholczyk running the business activity under the name ACTIV Tomasz Pacholczyk with headquarters in Wrocław at Graniczna 8B, building DC2A, 54-610 Wrocław, NIP 898-109-91-94, REGON 931088416 hereinafter referred to as GUARANTEE.

 

  1. The warranty is granted for new equipment and furniture and related accessories. The warranty does not apply to other goods offered through the elcartel.pl store.

 

  1. Third The warranty is given for a period of 12 months from the date of delivery of items purchased via the store elcartel.pl to the buyer.

 

  1. th Territorial scope of the warranty is limited to the territory of the Republic of Poland.

 

  1. GUARANTEE is responsible for physical defects found during the warranty period, if these defects arise from causes inherent in the item sold.

 

  1. The warranty does not cover: a) power supply cables, b) communication cables, c) electric heaters, thermostats, d) products flooded with liquids e) mechanical damage, f) damage caused by dust, g) defects caused by improper maintenance (all upholstered furniture should not be cleaned / maintained with preparations containing alcohol), h) products in which interference of third parties has been found, i) Goods with damaged factory seal, j) Goods with obliterated or removed serial number to the extent preventing identification of the number, k) Overheating of the device as a result of too long operation, l) Components subject to wear (clutches, filters, bearings, spindles, commutators, brushes, fuses, bulbs, gaskets), m) Devices damaged as a result of overvoltage or power supply overload. This provision does not apply to consumer sales.

 

  1. If a physical defect is found during the warranty period the holder of the warranty may request repair of the goods. In particularly justified cases GUARANTEE may decide to replace the goods with a new one. 8.

 

  1. GUARANTEE may refuse to satisfy the request of the holder of the guarantee to remove the defect if the cost of implementation of this request exceeds the price paid for the goods. This provision does not apply to consumer sales.

 

  1. In order to exercise the rights under the warranty the person entitled under the warranty is obliged to deliver the goods to the registered office of GUARANTEE or to the authorized service along with the complaint. Costs of delivery of goods purchased under the business shall be borne by the person entitled to the warranty. The list of authorized service is available on elcartel.pl website. The holder of the guarantee is obliged to properly pack the goods to protect them from damage, as well as the appropriate release of the advertised goods, in a situation where it is received by GUARANT or other entity acting on his behalf.

 

10 The basis for recognition of the complaint under the warranty is properly completed by the vendor warranty card together with proof of purchase of goods.

 

  1. A detailed description of the defect and the circumstances of finding the fault, b) personal data and address of the person entitled to the warranty.

 

  1. If the complaint report does not contain data that would enable proper consideration of the complaint, GUARANTEE will call the holder of the guarantee to complete the application within a period not shorter than 7 days. The time limit for implementation by GUARANTEE obligations under the warranty begins from the date of completing the complaint notification by the person entitled to warranty.

 

  1. The goods supplied by the holder of the warranty should be clean and in a condition that allows for investigation of the complaint. In case of delivering dirty goods the guarantee will be considered after cleaning the goods at the expense of the holder of the guarantee according to the rates specified in the price list on the elcartel.pl website, after obtaining the consent of the holder of the guarantee. The period for performing the obligations under the guarantee then starts from the date of cleaning the goods. In case of refusal by the holder of the guarantee to clean the goods by the GUARANTEE, the goods will be returned at the expense of the holder of the guarantee.

 

  1. GUARANTEE is obliged to perform its obligations under this warranty within 31 days from the date of delivery of goods by the holder of the guarantee. The date of fulfillment of obligations under the guarantee is the date of notification to the holder of the guarantee of the implementation of these obligations.

 

  1. In case of unreasonable request GUARANTEE will inform him, within the period indicated in paragraph 14, about refusal of warranty repair.

 

  1. In the case of personal collection, the holder of the warranty is obliged to collect the goods (in the office of GUARANTEE or authorized service in which the warranty application was made) within 7 days from the date of notification of the execution of warranty repair by GUARANTEE or refusal of warranty repair.

 

  1. In case of failure to collect the goods within the period specified in paragraph 16, GUARANTEE will call the holder to collect the goods within the additional period not shorter than 14 days. After ineffective expiration of the additional time GUARANTEE will charge the holder of the warranty for the storage of goods in the amount of 2% of the value of the goods, not less than 5 PLN, for each day of storage.

 

  1. The risk of accidental loss or damage to the goods during the time from handing them over to the GUARANTEE to collect them by the holder of the warranty is borne by the GUARANTEE.

 

  1. If it is necessary to make repairs not covered by the warranty, the repair can be done by the GUARANTEE at the expense of the holder of the warranty, after obtaining the written consent of the holder of the warranty and accepting the price of diagnosis and repair of goods

 

  1. The rights under the warranty expire if the warranty holder does not report a defect in the goods within 30 days from the date of detection.

 

  1. The rights under the warranty are entitled to the buyer who purchased goods directly from the GUARANTEE.

 

  1. This warranty does not exclude, limit or suspend the rights of the person entitled under the warranty arising from the provisions of the warranty for defects in sold goods.
